I did some checking on EPA's letter to the Air Force (copy attached) regarding your citizen petition for a preliminary assessment of the Kirtland Air Force Base jet fuel spill in Albuquerque, New Mexico. The letter, dated January 31, 2014, was mailed from our office to the Air Force. It is my understanding that the Kirtland AFB does have a copy of the petition.
Attached below is information received from Tomas Manning of the Air Force yesterday.

Subject: November 21,2013 KAFB NPL Petition
Dear Sirs and Madame,
I was informed by letter of January 24, 2014 that the Citizen Action, et.al., 11/21/2013 petition for NPL listing for the Kirtland AFB jet fuel spill was sent to the Air Force for consideration. I was informed by Region 6 staff that the letter was sent to Ms. Kathleen Ferguson, Acting Assistant Secretary of the Air Force Installation, Environment and Logistics.
On 3/19/2014, I was informed by KAFB Counsel Barry Shupe who made calls to Washington, D.C. AF that in fact the NPL Application has not been received by the Air Force although they are aware of its existence. This amounts to a five month delay for consideration of the petition out of a time period of one year for consideration of the petition. Citizen Action is not agreeing to waive time for consideration of the Petition.
I request receiving an electronic copy from the EPA Region 6 showing proof of service of the November 2013 Petition on the AF that EPA identified by its January 24, 2014 letter to Citizen Action, et al. The 11/21/2013 Petition should also be sent again to the Air Force since they do not have the Petition. I additionally request that Region 6 provide me with proof of service of the Petition on the AF.
I request that the AF notify Citizen Action of its receipt or non-receipt of the petition from EPA Region 6 within three business days.
I left telephonic messages on both Mr. Villareal and Ms. King's extensions regarding this matter on 3/19/2014 and spoke with Mr. Villareal a month ago about the matter.
